India stands among the world’s most biodiverse nations, a distinction earned through its unique geography and climatic variations. With just 2.4 percent of the world’s land area, India accounts for about seven to eight percent of all recorded species, making it one of only seventeen megadiverse countries globally. What makes India’s biodiversity particularly special is its high level of endemism-species found nowhere else on Earth. Nearly 28 percent of India’s fauna species are endemic, including unique amphibians like the purple frog and distinctive reptiles found only in specific mountain ranges or island ecosystems. This uniqueness extends beyond animals to plants, where thousands of endemic species have evolved in isolation across India’s varied landscapes.
Biodiversity hotspots: islands of exceptional richness
India contains four of the world’s 34 biodiversity hotspots-regions that are both exceptionally rich in species and under significant threat. The Western Ghats, the Himalayas, the Indo-Burma region, and the Nicobar Islands represent concentrations of unique life forms that have evolved over millennia. The Convention recognizes that countries have sovereign rights over their biological resources and should benefit equitably from their use, particularly when traditional knowledge contributes to commercial applications.
The Act serves three main objectives: conserving biological diversity, promoting sustainable use of biological components, and ensuring fair and equitable sharing of benefits arising from the use of biological resources and associated traditional knowledge. This framework acknowledges that local communities who have conserved and utilized biological resources for generations deserve recognition and compensation when their knowledge is commercialized.
Institutional framework and implementation
To implement the Act’s provisions, India established a three-tier institutional structure. At the national level, the National Biodiversity Authority headquartered in Chennai regulates access to biological resources by foreign entities and oversees benefit-sharing arrangements. State Biodiversity Boards operate at the state level, managing access by Indian citizens and organizations for commercial purposes. At the local level, Biodiversity Management Committees work with communities to document and manage biological resources.
The Act requires that foreigners, non-resident Indians, and foreign companies obtain permission from the National Biodiversity Authority before accessing Indian biological resources or associated traditional knowledge for research or commercial use. Even transferring research results based on Indian biological resources to foreign entities requires approval, ensuring that India retains control over how its biological wealth is utilized.
Key provisions and enforcement
One innovative feature of the Act mandates the creation of People’s Biodiversity Registers-community-level documentation of local biological resources, their uses, and associated traditional knowledge. These registers serve multiple purposes: preserving traditional knowledge, preventing biopiracy, and establishing prior claims when communities seek benefit-sharing from commercial applications.
The Act includes significant penalties for violations, with offenses carrying up to five years imprisonment and fines that can reach ten lakh rupees or more depending on the damage caused. All offenses under the Act are non-bailable and cognizable, reflecting the seriousness with which India views threats to its biological heritage.
The legislation also empowers authorities to designate biodiversity heritage sites-areas of particular biological importance requiring special protection and management. State governments develop conservation strategies and integrate biodiversity considerations into sectoral policies, creating a comprehensive approach to protecting biological diversity.
Balancing conservation with development
Effective biodiversity conservation in India requires more than laws and protected areas-it demands thoughtful integration of conservation goals with economic development and human wellbeing. Success stories exist where communities benefit from conservation, whether through ecotourism, sustainable harvesting of forest products, or payments for ecosystem services. These approaches recognize that people are part of ecosystems, not separate from them.
The challenge moving forward involves strengthening implementation of existing legal frameworks, increasing resources for conservation agencies, building capacity in local communities, and fostering greater public awareness about biodiversity’s value. Technology offers new tools-satellite monitoring can detect illegal forest clearing, DNA analysis can track wildlife trafficking, and citizen science apps enable ordinary people to contribute to biodiversity documentation.
